« Back Court dismisses defamation case against Sanjay Nirupam 28 Jul, 2009 A local court today dismissed a private complaint of defamation filed by former union minister and actor late Sunil Dutt against Congress MP Sanjay Nirupam.
The magistrate court judge A Wankhede, while dismissing the case, held that the application is not maintainable and hence deserved to be dismissed.
After the death of Dutt on May 25, 2005, his daughter Priya Dutt, who is also a Lok Sabha member, moved the court saying that she is the legal heir of Sunil Dutt and wants to prosecute Mr Nirupam, who had defamed the image of her father in the eyes of public. The court, while dismissing the application, said applicant Priya Dutt cannot decide that her father was defamed.
In 2004 Parliament elections, Dutt had filed a defamation case against Mr Nirupam, who accused him for hardly attending Parliament. At that time, Dutt was the Congress candidate from the Mumbai North-West Lok Sabha constituency, while Nirupam was his poll rival and was Shiv Sena candidate from the same constituency. Advocate Majeed Memon, who appeared for Dutt, while talking to UNI, said that Mr Nirupam had defamed the Congress leader in his election campaign by accusing him of attending the last Lok Sabha on just three occasions. He also said that this was untrue and alleged that the statement had been responsible for Dutt losing goodwill among the electorate.
